Terms of Service

Please read these Terms of Service ("Terms") carefully before using Blackbox mobile application ("App") operated by TOSS (The Otherside Studios) ("we," "us," or "our").

1. Acceptance of Terms

By downloading, installing, or using Blackbox, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Blackbox is a secure vault application that allows you to:

• Create encrypted vaults to store files, photos, videos, notes, and other content
• Protect vaults with PIN, Pattern Match, or Piano Sequence unlock methods
• Sync encrypted vaults to cloud storage (your iCloud/Google Drive or Blackbox Cloud)
• Organize content into categories and albums
• Access vaults across multiple devices with cloud sync
• Backup and restore vaults securely

3. Zero-Knowledge Architecture

Blackbox is built on a zero-knowledge architecture, which means:

• We cannot decrypt, read, or access your vault data under any circumstances
• Your PIN, encryption keys, and vault contents never leave your device in unencrypted form
• If you forget your PIN, we cannot recover your data - this is by design to ensure your privacy
• You are solely responsible for remembering your PIN and maintaining access to your vaults
• We act as a pass-through service, storing only encrypted data that we cannot decrypt

4. Data Encryption and Security

4.1 Encryption Standards

• Encryption Standard: Industry-standard Advanced Encryption Standard (AES) with 256-bit keys
• Key Derivation: Secure key derivation function with sufficient computational cost to prevent brute-force attacks
• Encryption Mode: Secure block cipher mode with unique initialization vectors for each operation
• Client-Side Encryption: All encryption occurs on your device before any data transmission
• End-to-End Encryption: Data remains encrypted from your device through cloud storage
• Cryptographic Randomness: All encryption operations use cryptographically secure random number generation

4.2 Your Responsibilities

• You are responsible for choosing a strong PIN and keeping it secure
• You are responsible for remembering your PIN - we cannot recover it if forgotten
• You are responsible for backing up your vaults if you want to ensure recovery
• You are responsible for maintaining the security of your device
• You are responsible for managing your cloud sync settings

5. Free and Premium Versions

5.1 Free Version

The free version of Blackbox includes:

• Limited number of vaults (as specified in the app)
• Basic vault features and file storage
• PIN-only unlock method
• Local storage only (no cloud sync)

5.2 Premium Version

The Premium version is available as a subscription and includes:

• Unlimited vaults
• Advanced unlock methods (Pattern Match, Piano Sequence)
• Cloud sync to your iCloud/Google Drive or Blackbox Cloud
• Base cloud storage included with subscription
• Additional storage tiers available for purchase
• Advanced vault features and customization options

6. Subscription Model

6.1 Premium Subscription

• Premium is available as a monthly or yearly subscription
• Subscriptions are processed through RevenueCat and your app store (Google Play or Apple App Store)
• All purchases are subject to your app store's terms and conditions
• Payment is processed securely through your app store account
• We do not collect or store payment card information
• Subscriptions auto-renew unless cancelled

6.2 Cloud Storage

• Premium subscription includes base cloud storage
• Additional storage tiers are available for purchase as add-ons
• Storage purchases are linked to your Premium subscription
• Storage usage is tracked to enforce limits
• You can purchase additional storage if you exceed your base allocation

6.3 Subscription Terms

• Subscriptions are billed monthly or yearly, depending on your selection
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can cancel your subscription at any time through your app store settings
• Cancellation takes effect at the end of the current billing period
• Refunds are subject to your app store's refund policy
• If your subscription expires, Premium features (including cloud sync) will be disabled

6.4 Restoring Purchases

• You can restore your Premium subscription at any time through the App's settings
• Restoration requires the same app store account used for the original purchase

7. Cloud Sync Services

7.1 Cloud Sync Options

Premium users can choose between two cloud sync options:

• User's Storage: Encrypted vaults are synced to your own iCloud Drive (iOS) or Google Drive (Android) account. You maintain full ownership and control.
• Blackbox Cloud: Encrypted vaults are stored on our secure servers (AWS S3). We store only encrypted data that we cannot decrypt.

7.2 Cloud Sync Terms

• Cloud sync is disabled by default - you must explicitly enable it
• You can choose which vaults to sync (per-vault control)
• You can switch between sync methods at any time
• You can disable cloud sync entirely at any time
• All synced data remains encrypted and unreadable by us
• You are responsible for managing your cloud storage limits
• If you exceed storage limits, you must purchase additional storage or delete data

7.3 Data Ownership

• You retain full ownership of all vault data
• When using user's storage, data is stored in your own cloud account
• When using Blackbox Cloud, you maintain ownership - we only store encrypted blobs
• You can delete your cloud data at any time
• If you delete your Blackbox Cloud account, all encrypted vaults are permanently deleted

8. User Content and Responsibilities

8.1 Content Ownership

• You retain all rights to content you store in vaults
• All content is encrypted and stored locally on your device
• We do not access, view, or process your content
• You are solely responsible for the content you choose to store

8.2 Prohibited Use

You agree not to use Blackbox to:

• Store content that violates any laws or regulations
• Store content that infringes on intellectual property rights
• Store illegal, harmful, or offensive content
• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract encryption keys
• Interfere with or disrupt the App's security features

8.3 Data Loss

• We are not responsible for data loss due to forgotten PINs
• We are not responsible for data loss due to device failure, loss, or theft
• We recommend enabling cloud sync for backup purposes
• You are responsible for backing up your PIN and maintaining access to your vaults
• We cannot recover your data if you lose your PIN or device

9. Intellectual Property

9.1 App Ownership

Blackbox, including its design, features, and functionality, is owned by TOSS (The Otherside Studios) and is protected by copyright, trademark, and other intellectual property laws.

9.2 User Content

You retain all ownership rights to content you create or store using Blackbox. We do not claim any ownership over your content. Due to our zero-knowledge architecture, we cannot access your content anyway.

9.3 Third-Party Services

Blackbox uses third-party services including:

• RevenueCat: For subscription management
• AWS S3: For cloud storage infrastructure (Blackbox Cloud)
• iCloud Drive / Google Drive: For user's storage option
• Expo: For app development framework

These services are subject to their respective terms of service and privacy policies.

10. Disclaimers and Limitations

10.1 Service Availability

• We strive to keep Blackbox available and functional, but we do not guarantee uninterrupted access
• The App may be unavailable due to maintenance, updates, or technical issues
• Cloud sync depends on third-party services (iCloud, Google Drive, AWS) which may experience outages
• We reserve the right to modify, suspend, or discontinue the App or cloud services at any time

10.2 No Warranty

Blackbox is provided "as is" without warranties of any kind, either express or implied. We do not warrant that:

• The App will meet your specific requirements
• The App will be error-free or uninterrupted
• Defects will be corrected
• The App is free of viruses or other harmful components
• Cloud sync will always be available or reliable
• Your data will never be lost (you are responsible for backups)

10.3 Limitation of Liability

To the maximum extent permitted by law, TOSS (The Otherside Studios) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of Blackbox. This includes, but is not limited to:

• Data loss due to forgotten PINs
• Data loss due to device failure, loss, or theft
• Cloud sync failures or data corruption
• Third-party service outages (iCloud, Google Drive, AWS)
• Security breaches (though we maintain strong security practices)

11. Indemnification

You agree to indemnify and hold harmless TOSS (The Otherside Studios) from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of Blackbox, violation of these Terms, or storage of prohibited content.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the "Last Updated" date. Your continued use of Blackbox after changes constitutes acceptance of the modified Terms.

13. Termination

13.1 By You

You may stop using Blackbox at any time by uninstalling the App from your device. You can also delete your Blackbox Cloud account, which will permanently delete all encrypted vaults stored on our servers.

13.2 By Us

We reserve the right to terminate or suspend your access to Blackbox or Blackbox Cloud at any time, with or without cause or notice, for any reason, including violation of these Terms. If we terminate your Blackbox Cloud account, we will provide reasonable notice and allow you to download your encrypted vaults.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TOSS (The Otherside Studios) operates, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising out of or relating to these Terms or Blackbox shall be resolved through good faith negotiation. If a dispute cannot be resolved through negotiation, it shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TOSS (The Otherside Studios) regarding your use of Blackbox and supersede all prior agreements and understandings.

If you downloaded Blackbox from Google Play or the Apple App Store, you also agree to:

• Google Play Terms of Service (for Android users)
• Apple Media Services Terms and Conditions (for iOS users)
• Your app store's refund and cancellation policies

In case of conflict between these Terms and your app store's terms, your app store's terms shall govern with respect to purchase and payment matters.
